1. Scope

These Terms of Use govern access to and use of the web app at https://exchange.valuequest.ch/ (hereinafter referred to as the “Platform”) by registered users who have been invited by ValueQuest GmbH. The operator is:

Use exclusively by registered users of legal age
No disclosure of access data to third parties
Use only for lawful purposes within the scope of the business relationship with ValueQuest GmbH

3. Registration and access

Access is by invitation only
Users are obliged to treat their access data confidentially
ValueQuest GmbH may block or delete user accounts at any time if these terms and conditions are violated

4. Rights to content

All content provided on the platform (text, files, logos, software) is the property of ValueQuest GmbH or authorized third parties
Users may only use transmitted files for the agreed business purpose
Users grant ValueQuest GmbH the right of use necessary for the fulfillment of the contract for uploaded files

5. Prohibited actions

Unauthorized access, circumvention of security functions
Transmission of malware
Use of the platform for illegal or anti-competitive purposes
Automated data queries or mass downloads

6. Data protection

Personal data is processed in accordance with our privacy policy at
https://exchange.valuequest.ch/privacy-policy.
The platform is operated in Switzerland.

7. Availability

ValueQuest GmbH strives to ensure high availability but cannot guarantee uninterrupted use. Maintenance work or technical malfunctions may temporarily restrict access.

8. Liability

Liability for direct damages only in cases of intent or gross negligence
No liability for indirect damages or consequential damages (e.g., lost profits, loss of data) to the extent permitted by law
Users are responsible for backing up their uploaded and downloaded data

9. Term and termination

The right of use is valid until revoked. ValueQuest GmbH may terminate access at any time with immediate effect.

10. Applicable law and place of jurisdiction

Swiss law applies exclusively. The place of jurisdiction is Zurich, Switzerland.
